These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TopTrade Challenge ("Company," "we," "us," or "our"), governing your access to and use of our mobile application, website, and all related services (collectively, the "Services"). Please read these Terms carefully before using our Services.
By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any policies and guidelines incorporated by reference (including our Privacy Policy). If you do not agree to these Terms, you must not access or use the Services.
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App, via email, or by posting a revised version on our website. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.
TopTrade Challenge is a simulated trading challenge platform. All trading activity conducted on the platform is performed using virtual (simulated) capital only. No real money is deposited, invested, or placed at risk during any trading activity on the platform.

Trading results achieved on our simulated platform are not indicative of, and should not be construed as a guarantee of, future real-world trading performance. Past performance is not indicative of future results.
The Services are designed to provide a skill-assessment and educational environment where users can test and improve their trading strategies in a risk-free, simulated setting.

We reserve the right to refuse service, terminate accounts, or restrict access to the Services at our sole discretion if eligibility requirements are not met.
To access certain features of the Services, you must create an account by providing a valid email address and creating a password. You may also be required to provide additional personal information as part of the registration process.

The Company shall not be liable for any loss or damage arising from unauthorized access to your account due to your failure to safeguard your credentials.
Each individual may maintain only one active account. Creating multiple accounts to circumvent platform rules, exploit promotions, or abuse free trials is strictly prohibited and may result in immediate account termination.

A challenge is deemed failed if, at any point during the evaluation:
Failure determination is calculated in real-time and is immediate and irrevocable. Failed challenge accounts are permanently closed and cannot be reinstated. No refunds will be issued for failed challenges.
Upon completion of all evaluation phases, users may claim applicable rewards through the platform's dashboard, subject to the reward terms described in Section 7.
Participation in paid challenges requires a one-time exam fee as displayed on the pricing page at the time of purchase. All prices are denominated in United States Dollars (USD) unless otherwise specified.

All payment processing is handled by third-party providers subject to their own terms and privacy policies. The Company does not store full credit/debit card information.
All challenge fees are non-refundable once the challenge account has been activated. If a payment is made but the challenge has not been activated due to a technical error, please contact us within 7 days for resolution.
From time to time, we may offer discounts, coupons, or promotional pricing. Such offers are subject to their specific terms and conditions, may be limited in quantity and duration, and may not be combined unless expressly stated.
Rewards are granted upon successful completion of all challenge phases, subject to:
Available rewards may include performance-based payments, gift cards, discount coupons, or other items as specified for each challenge plan. The specific reward package is displayed on the product page at the time of enrollment. All rewards are granted based on demonstrated trading skill and are not games of chance.
Reward claims require submission of valid recipient information. Processing times vary and are subject to internal review. We reserve the right to delay or deny reward claims if we suspect fraudulent activity, rule manipulation, or violation of these Terms.
We may offer free trial challenges at our discretion. Free trial participation is limited to users who do not currently have an active challenge. Free trial rewards (e.g., discount coupons) are subject to their specific terms.
Our referral program allows users to earn rewards by inviting others to the platform. Referral rewards are subject to the program's terms, which may be modified at any time. Abuse of the referral system (e.g., self-referral, fake accounts) will result in forfeiture of rewards and possible account termination.

Violation of this section may result in immediate account termination, forfeiture of all pending rewards, and potential legal action.
All content, features, functionality, trademarks, logos, designs, text, graphics, software, and other materials available through the Services are the exclusive property of TopTrade Challenge or its licensors and are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

You agree to indemnify, defend, and hold harmless TopTrade Challenge, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any third-party rights.
We may suspend, restrict, or terminate your account and access to the Services at any time, with or without cause, with or without notice, including but not limited to situations where:
You may terminate your account at any time through the App settings (Profile → Account Deletion) or by contacting us at [email protected]. For account deletion instructions and retention details, please review our Account Deletion page. Account termination does not entitle you to a refund of any fees paid.
Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including but not limited to Sections 10–13, 15–16) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable arbitration body in the Company's jurisdiction.
